Be Smart and Protect Your Assets!

Priceless Cargo Transport takes every measure to insure the comfort of each and every animal to the best ability to reach their destination with the least amount of stress and in the best health as possible. There are those times that are unforeseen or under laying health conditions we do not know about, and that is where the shipper needs to have measures to protect their assets. 

It is the shipper's (meaning YOU) IS responsible for all medical  and mortality insurance, or can elect not to carry horse medical and mortality insurance and thereby assume ALL  risk of loss and damages (to include but not be limited to injury, death, illness or disease, physical damage or harm). Shipper understands and acknowledges that the only insurance provided to the Shipper by Transporter is a maximum of one thousand dollars ($2,000) of limited accidental mortality insurance per horse transported.

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRANSPORTER SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, RELIANCE, INCIDENTAL, SPECIAL, DIRECT OR INDIRECT DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS OR FUTURE BREEDING VALUE, PERSONAL INJURY OR ANY OTHER LOSSES UNDER ANY LEGAL THEORY INCLUDING CONTRACT AND TORT, ARISING FROM, OR IN CONNECTION WITH, THIS AGREEMENT EVEN IF TRANSPORTER HAS BEEN FIRST ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES OR LOSSES. TRANSPORTER’S ENTIRE LIABILITY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY SHIPPER. SOME STATES OR JURISDICTIONS DO NOT PROVIDE FOR EXCLUSIONS OR LIMITATIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. AS SUCH, IN THOSE JURISDICTIONS, THE FOREGOING LIMITATION MAY NOT APPLY.

 

Priceless Cargo Transport, LLC carries physical liability insurance as required by the FHWA and the State of Oregon. Horses are shipped under a declared value provision as specified on our Bill of Lading.

 

Priceless Cargo Transport, LLC is not responsible for conduct or acts of horses to themselves or each other, nor loss or damage arising from the condition of the animals themselves, or which results from their nature or propensities. Trip insurance, if desired, should be arranged by the customer through his/her insurance agent. We will be glad to recommend an agent.
